Residential Burglary Arrest

On July 13, 2012 at approximately 6:00pm, the Newton Police received a report of a residential burglary at 3 Cherry Street. Patrol Officers arrived and met with the homeowner who stated that he returned home and discovered that his rear door was damaged and that his living room was ransacked. The homeowner had previously installed surveillance cameras in and around his residence. The surveillance video was viewed and it showed a white male kick in the rear door and enter the residence and attempt to steal a television and/or other electronic equipment. After a few moments, the male subject exited the residence without stealing anything. The male subject was wearing a t-shirt with a distinctive logo, shorts, black sneakers, and gloves. The subject also wore something over his face to try and conceal his identity.
Additional surveillance video was located around the area where the burglary occurred. The video showed the same male who matched the subject in the video from the residence that was burglarized. He was identified as Herbert W. Whitesell, III, an unemployed 31 year old male from Newton. Though he was identified, he was not able to be immediately located.
On July 31st, Whitesell was located by Newton Police and taken into custody. He was charged with the following offenses:
· Burglary, N.J.S. 2C:18-2a, a Crime of the Third Degree
· Attempted Theft, N.J.S. 2C:5-1a of 2C:20-3a, a Crime of the Third Degree
· Criminal Mischief, N.J.S. 2C:17-3a, a Disorderly Persons Offense
Judge John E. Mulhern, JMC authorized the complaint warrant for Whitesell and set bail at $10,000 with no 10%. Whitesell was then lodged in the Sussex County Jail in default of bail.
The investigation was conducted by members of the Newton Police Departments’ Patrol Division and Detective Bureau.
