West Orange Resident Claims Wrongful Eviction: Eviction Set for Today

I want to make everyone aware of the unjust court judgment ruled against me on Monday, August 6, 2012 by Judge Mahlon Fast.

I need help in overturning the court’s decision to evict me on August 9, 2012 from my apartment at 10 Shepard Terrace, West Orange, NJ 07052. I will have nowhere to live with my special needs son effective Thursday, August 9th.  It is very important that the court transcripts are requested and reviewed. These documents speak for themselves.

My first court date was May 2, 2012, I received no notice (no fault of the court as I have had mail missing before). On May 14th, there was a warrant of removal on a table outside my door dated for a 5/16 lock out.  On May 15th I went to court to file an order to “Show Cause” to stop the May 16th lock out and the return court date was 5/23/12. Judge Fast dismissed the landlord’s complaint. The Landlord made accusations against me. I tried to defend myself. Judge Fast told me to “shut up” or he would have me arrested and thrown in jail. He then claimed “Bad Blood” based on what the Landlord was saying, but wouldn’t allow me to talk and the Judge interrupted my lease which was through Jan 2013 with a 90 day hardship stay. Judge Fast then educated my landlord on accelerating eviction and my landlord has been bringing me to court several times with bogus complaints.

On 6/18, the Landlord took me to court and the judge dismissed her case for the 2nd time.  On July 25th, I arrived home from the emergency room to find a notice for a July 26th court date requested by the Landlord with no explanation.  I began mandatory treatment for my medical condition on the 26th of July.  The judge ordered a lock-out on the 26th without me present in court effective August 1st date even though he received a letter from my medical professionals that my condition did not allow me to be in court until after 8/9/12.

It was necessary to retain an attorney who filed another “Order to Show Cause” to prevent ANOTHER lock out effective 8/1/12. This would be the 3rd time the landlord took me to court so I could prevent another lock out. We returned to court on 8/6/12 and Judge Fast did not hear the case and ordered the lock out effective August 9, 2012.

The judge would not listen to my case and did not give me a chance to present my case before the court. The judge did not review my supporting documents.  This case was never rightfully heard and it is imperative for the transcripts to be reviewed for fairness by the judge.  I understand the courts are on overload but this is a very serious and dangerous consequence for my son and I. 

My rent has been given monthly and in full. I believe that my landlord is evicting me for reporting her for rental of an illegal basement apartment to the Township and the use of all the electric on my billing invoices. The electic billing has been corrected,  but the basement apartment is still in use. Additionally, pending complaints were filed against Ms. Destin. One filing was dismissed because I did not attend the arraignment as I was in Landlord/Tenant court at the time.

The appellate court denied my appeal and the eviction stands.  I will not and cannot vacate my apartment on August 9th.
