Acting Essex County Prosecutor Carolyn A. Murray announced that Nolvin Garcia, 24, also known as Jose Elvin Lendos Garcia, of Orange and a citizen of Honduras,  has been arrested for the murder of Jacques Nelson, 32, of Orange. The shooting occurred in the parking lot of Misty's Restaurant on Main Street, around 2:30 am, on August 6, 2012.  The defendant was arrested in Texas, attempting to enter Mexico approximately one week after the homicide. He was returned to New Jersey by law enforcement authorities in Texas to answer the murder charge. Nelson worked as a bouncer at the restaurant and was attempting to intervene in a dispute when the shooting took place.  He was a father of 4.

Assistant Prosecutor Eileen O’Connor’s moved to increase the defendant’s bail from $750,000 to $1 million and to require that the source of the funds used the pay the bail is proven legitimate. O’Connor argued that the increase and conditions were warranted due to the risk of flight posed by the defendant as evidenced by his attempt to enter Mexico as well as his ties to Honduras. The Honorable Peter J. Vazquez, J.S.C. agreed and ordered that bail conditions be changed.

Note: All defendants are presumed innocent unless and until they plead guilty or are found guilty in a court of all.
