Two Charged With Shoplifting From Newton's Weis Markets Location

On 2/10/13 at 10:24a.m., Newton Police responded to Weis Market for a report of male and female shoplifters who had stolen a quantity of baby formula before fleeing the area on foot heading east on South Park Drive.
Upon arrival, patrols observed a male and female on South Park Drive that matched the description of the actors. Subsequent investigation revealed that the male actor, later identified as Herbert Whitesell 3rd, 31, of East Culver Lake Road, Branchville was in possession of several containers of baby formula valued at over $400.00. Whitesell did not initially comply with officer’s orders and was subdued and handcuffed after a brief foot chase and physical struggle.
The female actor, identified as Shannon Foley, 21, of Bassett Lane, Hampton, was arrested for being in possession of a hypodermic syringe but was not charged with shoplifting as she was not present inside the store during the theft.
All stolen items were recovered and returned to Weis Market.
Whitesell was charged with the following offenses:
N.J.S. 2C:20-11c(3) Shoplifting (4th Degree)
N.J.S. 2C:29-2a Resisting Arrest (Disorderly Persons Offense)
Foley was charged with the following:
N.J.S. 2C:36-6 Possession of a hypodermic syringe (Disorderly Persons Offense)
