These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the County of Morris Board of Chosen Freeholders.

Request for Release of Funds

On or about September 22, 2012 the Madison Affordable Housing Corporation will submit requests to the Newark Office of the U.S. Department of Housing and Urban Development for the release of SHOP and Home Investment Partnerships Program funds under Title II of the National Affordable Housing Act of 1991 under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the following projects’ activities:

 

Project:  Construction of Housing

Activity Location: 22 Orchard Street, Madison, NJ

Description: Funds utilized to construct 3 units of Affordable Housing-Madison Affordable Housing Corporation

Estimated Cost: $3,306,100. with a HOME award of $100,000. A Self-help Homeownership Opportunity Program(SHOP) award of $30,000 is also being utilized in this project.

 FINDING OF NO SIGNIFICANT IMPACT

The Borough of Madison has determined that the project activities will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project activity information is contained in the Environmental Review Record (ERR) on file at the Morris County Division of Community Development, 30 Schuyler Place, Morristown, NJ and may be examined or copied weekdays 9:00 A.M. to 4:30 P.M.

PUBLIC COMMENTS

Any individual, group, or agency disagreeing with this determination or wishing to comment on the project activities may submit written comments to the Borough of Madison at the address noted above.  All comments received by September 20, 2012 will be considered by the Borough of Madison and the Madison Affordable Housing Corporation (MAHC) prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

 RELEASE OF FUNDS

The Borough of Madison certifies that Louis A. Riccio in his capacity as Executive Director of the MAHC consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Madison Affordable Housing Corporation to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

 HUD will accept objections to its release of funds and the Borough of Madison’s  certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Madison; (b) the Borough of Madison has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the projects are unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD, Newark Area Office, Community Planning & Development at One Newark Center, Newark, NJ 07102-5260. Potential objectors should contact HUD to verify the actual last day of the objection period.
