A Montgomery Township woman, who police said has two prior convictions for retail theft, has been arrested and charged with third-degree felony retail theft for allegedly stealing $55 sneakers from JCPenney at Montgomery Mall.

Kathryn Ann Dougherty, 34, of the 200 block of Twining Road, was charged July 30 by police with the felony from an incident that occurred July 19 at the Montgomery Township mall. She was issued a summons to appear at a Sept. 8 preliminary hearing before District Judge Andrea Duffy in Montgomery Township District Court.

Montgomery Township Police were dispatched to JCPenney for a reported retail theft at 11:41 a.m. The loss prevention officer told police he saw a white female, who police allege is Dougherty, take a pair of sneakers from the display and bend down in the aisle.

Dougherty allegedly took the sneakers out of the box and concealed them in her handbag, police said. She then left the store without paying, police said.

Loss prevention officers stopped Dougherty outside the store. She was cooperative and allegedly admitted taking the sneakers, according to the affidavit. The sneakers were recovered from her purse. She was taken into custody and processed at Montgomery Township Police Department.

Dougherty is awaiting trial in Montgomery County Court of Common Pleas on numerous misdemeanor DUI offenses from October 2013 in Montgomery Township, according to court records.

In December 2010, she pleaded guilty to DUI and drug possession offenses from a September 2010 arrest in Montgomery Township, and she was sentenced to time served to six months in prison, according to court records. Dougherty also received one year probation concurrent with confinement.

She was found guilty in June 2010 of drug possession in Philadelphia, per court records. She was also found guilty of a possession of a controlled substance charge in 2007, stemming from a Montgomery Township arrest.
