Residents have been muzzled during the almost two years of hearings. They have only been allowed to ask specific questions after a witness has finished. They have not been allowed to make a statement. The Chairman of the Zoning Board has promised from day one that he would allow brief statements from all residents at the end of the hearings.
It is very important that residents know we are now at or toward the end and a decision. Many were busy and could not attend the many 4 hour sessions but wanted to know when they could make their statements and have followed the case in your news source. Finally, residents of Millburn and Short Hills will be allowed to speak out about The Chai Center’s request to build an oversized structure on an undersized lot.
The next to last Millburn Zoning Board of Adjustment meeting will be held Monday, January 30, 2012.
The Chai Center Zoning hearings, regarding their request for multiple variances began 21 months ago. The first meeting was held at Hartshorn School on April, 2010.
While there were some months where no meeting was held, these hearings have been going on for close to two years now.
The upcoming January 30th meeting to be held again at Hartshorn School beginning at 7pm. Here is what is planned for the agenda for that night.
It is expected that Ciro Gamboni, one of the parties fighting against approval of the variances, will be called as a witness to testify about the conditions and hardships he feels approval of the variances would cause.
Rabbi Mendel Bogomilsky is expected to be recalled to make his final statement.
Also, Township Planner Paul Phillips is expected to be recalled to give testimony.
Once that is completed, it is anticipated there will be time left in the January 30th session for interested residents to state their name and address and give their comments. In the past, residents were only allowed to ask specific questions of the various witnesses and not make public statements.
Then for all those residents who either can not make the January 30th meeting or time does not allow for them to speak, the final session is scheduled for February 13th.
When every resident has had a chance to make a statement the lawyers for both sides will make their final summations before the Zoning Board votes and makes their decision.
