Evan Gutman, CPA/CFF/CGMA, Highlighted In Business Trade Publication

Livingston, NJ – Evan Gutman, CPA/CFF/CGMA, Levine, Jacobs & Company, L.L.C., www.ljcpa.com was highlighted in the September 2013 issue of Commerce magazine – the flagship publication of the Commerce & Industry Association of New Jersey.
In the September 2013 issue of Commerce magazine, participants commented on various aspects of forensic accounting. Evan Gutman, one of the accountants participating, wrote about how investigation of case law can help resolve accounting issues. Mr. Gutman wrote: “The essence of forensics involves investigation. Forensic accounting and legal investigation often blend together.” The example Mr. Gutman chronicled involved a business valuation. During the course of the work it was learned that the business was located on a site with potential environmental issues. However, since no environmental study had been performed, it was not known for certain whether environmental issues existed. The potential environmental issues were determined to be a contingent liability. Case law was researched to ascertain how to address contingent liabilities in a valuation. A case directly on point was found that involved potential environmental liabilities. The Tax Court held that potential liabilities can affect value and the marketability discount utilized for the valuation. The case was cited in the valuation report to support the marketability discount utilized. The forensic work consisted of legal investigation to resolve an accounting issue.
