Chiropractor Sentenced to Six Months on Tax Charges

NEWARK, N.J. – A chiropractor who had offices in Paterson, N.J., was sentenced on Friday to six months in prison and six months home confinement for filing a false personal income tax return for 2003, U.S. Attorney Paul J. Fishman announced.
Yanal Kazan, 60, of Kinnelon, N.J., previously pleaded guilty before U.S. District Court Judge William J. Martini to one count of a five-count Indictment charging him with filing false income tax returns from 2003 through 2005. Judge Martini imposed the sentence today in Newark federal court.
According to documents filed in this case and statements made in court:
Kazan engaged in business as a chiropractor, with offices at 470 Chamberlain Ave., Paterson, through various entities he owned and operated, including Chiropractic Health Associates Inc.; Chiropractic Healing Arts P.C.; and Yanal Kazan, DC, PC, d/b/a/ Neck & Back Injury Center. Kazan received checks, which were income derived from his chiropractic business activity, issued by insurance companies, lawyers, and other parties.
Kazan and others acting under his direction cashed checks at a check cashing business in Paterson. Between March 2004 and April 2006, Kazan filed false personal tax returns for 2003, 2004, and 2005, which did not account for gross receipts of $414,704, $227,298, and $39,894, respectively, derived from Kazan’s chiropractic business activity.
In addition to the prison term, Judge Martini sentenced Kazan to one year of supervised release and fined him $10,000. Kazan has also agreed to repay the full amount of the tax loss, $106,298, plus civil penalties.
U.S. Attorney Fishman credited special agents of IRS – Criminal Investigation, under the direction of Special Agent in Charge Victor W. Lessoff, with the investigation leading to today’s sentence.
